Edge Builder Wall Panels Inc. – Statement of Limited Warranty

By the terms of this Limited Warranty, hereafter (Warranty), EdgeBuilder, Inc., hereafter (EdgeBuilder), extends a warranty on the permanent wood foundation, which is described herein and is fabricated by EdgeBuilder and installed by an EdgeBuilder certified installation crew. The 75-Year Limited Warranty for Longevity is not transferrable. The 25-Year Limited Leak Warranty is transferable twice, consecutively, from the original owner during the first ten years of the warranty (The original owner shall mean the first owner who purchases the home from Pratt Homes and shall not include Pratt Homes who constructed the home, who technically may own the home during the construction period). EdgeBuilder must be notified of any change of ownership within 60 days of the title transfer to effectuate the transfer and to keep the warranty in effect.

75-Year Limited Warranty Coverage for Longevity

This 75-year warranty is on the (FDN) treated wood portion of the foundation, including the wood basement floor system, which was installed by EdgeBuilder or an EdgeBuilder certified installation crew against fungal decay or termite damage to the degree that would make the Product structurally unfit for its intended purpose. The first twenty (20) years of the 75-year warranty will be at one hundred percent (100%) of the replacement costs, subject to the terms and conditions set forth herein with the fifty-five (55) year balance to be prorated by reducing the coverage by 1.82% each year. For example in year 19 the original owner would receive one hundred percent (100%) coverage on claims related to the wood portion of the foundation, in year forty (40) EdgeBuilder would cover sixty percent (63.6%) of the costs, in year sixty (60) EdgeBuilder would cover thirty percent (27.2%) of the costs.

This Limited Warranty Coverage is to include only the following:
EDGEBUILDER’S OBLIGATION FOR MATERIAL REPLACEMENT IN THE EVENT OF A BREACH OF WARRANTY OR CONTRACT OR OTHERWISE WITH RESPECT TO THE PRODUCT SHALL BE STRICTLY AND EXCLUSIVELY LIMITED TO THE COST OF LIKE KIND TREATED WOOD REPLACEMENT MATERIAL FOR ANY DEFECTIVE TREATED WOOD COVERED BY A VALID WARRANTY CLAIM MADE BY THE ORIGINAL WARRANTY HOLDER OF AN EDGEBUILDER 75-YEAR LIMITED WARRANTY ON PERMANENT WOOD FOUNDATIONS.
It would further include excavation, backfilling, nails, caulks, adhesives, fasteners, grade board, and poly only as necessary to facilitate the replacement of the defective treated wood.
Prior to any claim being deemed “valid” EdgeBuilder has the right, in its sole discretion, to have a representative inspect all wood, which is claimed to be damaged prior to its removal from service. In the event EdgeBuilder determines it will not have a representative inspect the wood on which a claim is made, EdgeBuilder shall so inform the owner in writing.

EDGEBUILDER DOES NOT WARRANT DAMAGE TO THE PRODUCT CAUSED BY WEATHERING OF THE WOOD INCLUDING, BUT NOT LIMITED TO, RAISED GRAIN, SPLITTING, CHECKING, SWELLING, TWISTING, WARPING, SHRINKING, DELAMINATION OF PLYWOOD OR LAMINATED PRODUCT(S) OR ANY OTHER PHYSICAL PROPERTY OF THE WOOD. EDGEBUILDER DOES NOT WARRANT PRODUCT WHICH HAS BEEN PHYSICALLY OR MECHANICALY DAMAGED, INCLUDING FUNGAL DECAY OR TERMITE ATTACK INDUCED BY SAID PHYSICAL OR MECHANICAL DAMAGE. EDGEBUILDER IS NOT RESPONSIBLE FOR MOLD GROWTH ON THE PRODUCTS. EDGEBUILDER DOES NOT WARRANT AGAINST CORROSION OF METAL HARDWARE USED IN CONJUNCTION WITH THE PRODUCT. ONLY STAINLESS STEEL FASTENERS AND HARDWARE SHALL BE USED BELOW GRADE, OR THIS WARRANTY AGREEMENT SHALL BECOME NULL AND VOID. DIRECT CONTACT OF THE PRODUCTS WITH ALUMINUM FASTENERS IS PROHIBITED. EDGEBUILDER DOES NOT WARRANT PRODUCT THAT WAS NOT BUILT, CONSTRUCTED OR INSTALLED BY AN EDGEBUILDER CERTIFIED INSTALLATION CREW. EDGEBUILDER DOES NOT WARRANT PRODUCT IF THE WOOD FOUNDATION WAS NOT BUILT, CONSTRUCTED OR INSTALLED IN ACCORDANCE WITH ALL APPLICABLE STANDARDS, INCLUDING BUT NOT LIMITED TO, THOSE ISSUED BY AWPA, APA, AFPA, NES AND ALL APPLICABLE BUILDING CODE(S). EDGEBUILDER IS NOT RESPONSIBLE FOR ANY DAMAGE TO THE PRODUCTS USED IN COMMERCIAL OR INDUSTRIAL STRUCTURES OR WOOD FOUNDATION SYSTEMS OTHER THAN THOSE DESCRIBED HEREIN, WOOD EXPOSED TO SALT WATER OR ANY CAUSE OTHER THAN FUNGAL DECAY OR TERMITE DAMAGE.
EdgeBuilder makes no other warranties, express or implied, of merchantability, fitness or a particular purpose or otherwise. In no event shall EdgeBuilder be liable for incidental, consequential, special or indirect damages. Nothing in this warranty shall affect the duration of implied warranties beyond their customary duration, or create additional implied warranties
This warranty in addition to being specifically for replacement only and not repair and maintenance, has the following exclusions:
A. Any damage resulting from misuse by owners is not covered.
B. Damages that may have been eliminated by timely notice are not covered.
C. Changes made by any party that affect the integrity of this product made after the date of giving the warranty are not covered. Examples are but not limited to: greater backfill depth than indicated on plans furnished or listed on contract, cutting through top plates, cutting or removing studs or plywood, drilling larger than necessary holes for wiring, any structural foundation changes not approved by EdgeBuilder.
D. Any cost or expense as a result either directly or indirectly relating to the floor covering, wiring, plumbing, drywall, wall coverings, paneling, windows, doors, or painting.
E. Removal, replacement or installation of landscaping items such as flowers, shrubs, rock, sod, decks, sidewalks, driveways, etc.

25-Year Limited Leak Warranty

This warranty provides a warranty for leaks, subject to the limitations provided herein. Leaks are described as ground water penetrating the Permanent Wood Foundation (PWF) exterior wall and flowing down the interior of the exterior wall below the earth grade line. This warranty only covers leaks that are caused by negligent workmanship, materials, or plans and specifications performed or supplied by EdgeBuilder.

EdgeBuilder will take all reasonable steps to correct a leak problem which will include required labor and materials described herein during the 25-year period when covered by a valid warranty claim made by a warranty holder of an EdgeBuilder 25-Year Limited Leak Warranty:
1. Exterior: Excavating as required, backfilling as required, drainage materials required if included in EdgeBuilder original contract, sealant caulks, polyethylene and labor required. Not included under this warranty is the replacement or installation of landscaping items such as flowers, shrubs, rocks or sod, decks, sidewalks, driveways, etc.
2. Interior: Sealant caulks, fasteners, adhesives and labor to install these materials as required. Not included under this warranty is any cost or expenses as a result either directly or indirectly relating to the floor covering, wiring, plumbing, drywall, wall coverings, paneling, windows, doors, or painting.

LIMITATIONS AND EXCEPTIONS:
A. This warranty does not apply and EdgeBuilder has no responsibility for mold, mildew, fungi or air quality.
B. This warranty does not apply and EdgeBuilder has no responsibility for leaks resulting from:
1. Backfill materials and procedures other than those approved in the Design, Fabrication and Installation Manual for Permanent Wood Foundations or as specified in EdgeBuilder backfilling details.
2. Defective or inadequate drainage to daylight from lowest footing level or a sump pump system to adequately remove excess ground water.
3. Exterior grading which does not slope away from the basement at a rate of at least ½” per foot for a minimum of 6’ away from the basement.
4. Water rising upward due to hydrostatic pressure. This would include water coming up through the joint where the exterior plywood meets the bottom wall plate, the joint where the basement floor meets the exterior basement wall or water coming up through cracks in the basement floor.
5. Non-existing, defective or inadequately functioning gutters or downspouts.
6. Openings or penetrations for pipes, cables, ducts and other intrusions into or alterations to any products installed by EdgeBuilder.
C. Condensation on the foundation walls, poly vapor barrier or interior finish.

Structural Design Limited Warranty

EdgeBuilder’s structural warranty will comply with the laws of the state for which the structure is being erected in at the time the building permit is issued for said contract.
All footings and concentrated point load footings or post pads will be based on 3000 pounds soil bearing capacity unless EdgeBuilder is informed in writing or unless it is indicated to the contrary on drawings submitted to EdgeBuilder as working plans prior to beginning of work on such project. All changes required after the project is started or the contract is signed are to be handled by a change order.
All structural design decisions, not shown on plans furnished to EdgeBuilder, will be made from the plans and/or the information furnished to EdgeBuilder by the general contractor including but not limited to the following: beam pocket size and locations, post pads size required, point load areas with concentrated loading weight to be dispersed, depth of backfill to be used on all sides, floor level changes, load bearing walls, window and door rough opening sizes including the location, shear walls when required and location. EdgeBuilder may review all of the above items and request that some changes or additions be made to the plan design submitted by general contractor to more adequately respond to the structural requirements of the structure.
These warranties made herein are not only supported by EdgeBuilder, but are also supported in part by EdgeBuilder suppliers.
In the event that any part of this agreement is deemed to be contrary to law or public policy in any state, that part of this agreement shall be void and the remainder of the agreement shall be of full force and effect.
